Warranty
I. Unfinished Flooring
American Made Flooring (AMF) warrants to its original purchaser that all products we sell will be of the quality, kind and grade as invoiced when these products leave our premises. Our flooring is manufactured in accordance with accepted industry standards which permit a defect tolerance not to exceed 5 percent. If any of these products are proven to our satisfaction to be defective in materials or workmanship in excess of the 5 percent defect allowance, they will be replaced with the same in kind or a refund will be made to the original purchaser equal to the purchase price of the material. AMF will not be responsible for any incidental or consequential damages (that is, damages occurring as a consequence of the defective flooring, time lost from work, or inconvenience). Some states do not allow the exclusion or limitation of incidental damages, so the limitation above may not apply to you.
Pre-Inspection:
Every plank should be inspected for manufacturing defects or grade problems before installation by a professional installer. Flooring must be inspected for quality of manufacture, grade and moisture content. It is your responsibility to confirm this before installation. AMF accepts no responsibility or liability for any problems discovered after installation of the floor.
Warranty Exclusions:
Any warranty will be considered null and void if the flooring is not installed by a professional flooring installer. AMF warranty does not cover scratches, indentations, or damages caused by negligence, water, insects, spiked heels, failure to follow proper installation procedures, improper maintenance, insufficient protection, misuse, or improper alteration. Hardwood flooring will continue to expand and contract through normal heating and cooling seasons. If minor separations occur, they are not covered by this warranty. No warranties apply to any product or products sold as seconds, economy or as-is. THE WARRANTY SET FORTH ABOVE IS GIVEN IN LIEU OF ANY OTHER WARRANTIES, WHETHER WRITTEN OR ORAL, EXPRESS OR IMPLIED AND ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE ARE HEREBY EXPRESSLY EXCLUDED BY AMF.
II. Prefinished Flooring
The parties recognize that naturally occurring wood characteristics, such as variations in grade, grain, color, mineral streaks and knots, alter the appearance of the finish. Am erican Made Flooring (AMF) warrants and guarantees the finish material is applied as stated in their Service Order in a good and workmanlike manner. Subject to the warranty exceptions described below; AMF guarantees and warrants its finish will not wear through to the wood or separate from the wood for twenty five (25) years from the date the original finish is applied to the wood by our Contractor. Subject to the warranty exceptions described below, if (1) our Contractor applies the wrong finish material, or (2) the finish bond fails within the warranty period, or (3) the finish wears through within the warranty period, AMF will re-finish the material free of cost to Owner. In the unlikely event AMF is unable to correct the finish after a reasonable number of attempts, AMF will refund, if requested by Owner, the price paid by Owner to AMF for the nonconforming portion of AMF’s services. Either the refinish of material or refund of amounts paid AMF for nonconforming services will be Owner’s sole and exclusive remedy.
Warranty claims for obvious finish defects must be filed with AMF within 180 days of the date the product is removed from AMF’s facility. Warranty claims for finish bond defects must be filed within the warranty coverage period. Information verifying date of services and product batch will be required with all warranty claims. AMF reserves the right to inspect the material and remove samples for technical analysis. Slight color variations and indentions in wood grain are normal, and are not covered by warranty. Warranty does not cover finished product installed with obvious finish defects. Warranty does not cover finish defects arising from or associated with defects in the underlying material. Warranty does not cover defects or damage caused by improper installation of the finished product, abuse or improper use of the finished product (including but not limited to use of abrasives on the finished product, sliding heavy objects across the finished product, damage caused by water or moisture changes, damage caused by spiked heels, pet scratches, insects, insufficient protection from furniture, pebbles, sand or other abrasives, and other forms of abuse or improper use). Warranty does not cover color changes caused by exposure to light, sunlight or ultraviolet radiation. Warranty does not cover gloss retention as gloss reduction normally occurs and is not a finish defect. Warranty is void if additional finish material is applied to the product. WARRANTIES UNDER THIS AGREEMENT ARE NOT TRANSFERABLE. THIS WRITING IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE EXPRESS WARRANTIES PROVIDED HEREIN AND IS IN LIEU OF ALL OTHER EXPRESS AND/OR STATUTORY WARRANTIES BY AMF. THERE ARE NO IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, EXTENDING BEYOND THE TERMS OF THIS WARRANTY. AMF ASSUMES NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. THE SOLE REMEDY PROVIDED HEREIN IS THE REFINISH OF DEFECTIVE FINISH, OR REFUND OF AMOUNTS PAID BY OWNER TO AMF FOR NONCONFORMING SERVICES.
III. Additional Terms and Conditions
Returns:
Returns are allowed only if the material meets the following requirements.
- The box (boxes) is unopened and complete.
- The time elapsed since purchase is 60 days or less.
- Receipt required for return.
- We reserve the right to refuse return due to moisture or visible condition of flooring. Must be able to resell without issue.
- There will be no returns on Custom Ordered Merchandise.
Restocking Fee:
There will be no restocking fee for up to 10% of the original order. Anything over 10% will be charged at 25% of the original purchase price.
Returned Checks will be charged $30.00. |
